Court Strikes Out Case Against Obiano, 4 Others

The Anambra State High Court sitting in Ogidi, Idemili North Local Government Area of Anambra has stroked out the suit No. HID/297/2016, filled by one Chuma Angus Ojukwu, against the state governor, Willie Obiano, for issuance of certificate of recognition to Igwe Michael Ezeudenna as the dully-recognized traditional ruler (Obi) of Awka-Etiti, Idemili South local government area.

Also Ojukwu joined in the suit, Attorney general and Commissioner for justice of Anambra State, the Commissioner for Local Government and Chieftaincy matters, and Michel Ezeudenna (Obi of Awka-Etiti), requesting among other things, an order of court to direct the 1st defendant to withdraw the certificate of recognition issued to 4th defendant on November 3, 2016 as the Obi of Awka-Etiti community; and issue it to him.

But delivering the judgment recently, the Anambra State Chief Judge, Justice Peter Umeadi, explained that the case was stroke out because the fundamental law governing its proceeding was not properly constituted.

Umeadi also pointed out that there were irregularities in signing the petition by the applicant, and that the lawyer, who represented the applicant, was alien to the case, showing that he was not mentioned in the initial submission of the case file, even as his firm was not registered in Nigeria, among other things.

Speaking to newsmen after the judgment, the Secretary, Igwe –In –Council of Awka Etiti, Ebele Enemuo, described judiciary as the hope for the common man, and called on his people to rally round the crowned Obi Ezeudenna in order to achieve much expected development in the town.

In his reaction, however, the lawyer to the plaintiff, Austin Arua said that his client would study the judgment and come out with decision whether to appeal or to fill another motion.
