Tension in Awka As Tribunal Strikes Out Election Petition Filed By PDP NASS Member

The Election Petition Tribunal sitting in Awka, the capital of Anambra State has rejected an application filed by the Peoples Democratic Party (PDP) candidate and winner for Awka North and South Federal Constituency, Chief Anayo Nebe seeking to strike-out the petition filed by his counterpart of All Progressive Grand Alliance (APGA), Chief Godson Ezenagu, challenging his victory on 2015 NASS election.

Rejecting the case in a motion during it pre-trail session yesterday, Chairman of the Tribunal, Justice Nayai Aganaba ruled that the tribunal would not deal with any interlocutory application at this stage as it is inclined to grant speedy hearing to the substantive petition.

While stressing that they would not entertain acts and issues capable of delaying the determination of the petition unnecessarily, the Justice explained that days would soon be allotted for the petitioner and respondents to argue their cases as well as time limit for cross examinations.

Challenging the application earlier, Counsel to the Petitioner, Mr. Kemi Pinheiro-SAN disclosed that the application was specifically calculated to delay and frustrate speedy determination of the petition.

Mr. Pinheiro noted that the petitioner has thirty witnesses to testify before the tribunal and a forensic expert who would analyze all result sheets and ballot papers and come up with reports that would assist the tribunal to reach a just decision.

On his part, Counsel to the First respondent, Mr. Arthur Obi-Okafor (SAN) prayed the tribunal to grant the application as a result of the various issues raised.

Speaking to journalists, Mr. Obi-Okafor, the Counsel to APGA, first respondent; and Mr. Emeka Etiaba, the Counsel to PDP, second respondent expressed hope that the petition would not take long time to be determined as both parties involved have agreed on documents to be tendered and admitted, and number of witnesses.
